Understanding Qualified Exemptions and Modified Requirements

This document focuses on explaining the requirements for produce farms that fall under the qualified exemption and modified requirements.

The Produce Safety Rule is one of the seven rules in the Food Safety Modernization Act. The Produce Safety (PS) Rule establishes guidelines for farms that grow produce for the safe production and harvesting of fruits and vegetables. The FDA considers that the standards in the PS Rule minimize the risk of consumers getting ill from eating contaminated produce with bacteria, viruses or other pathogens. Under the PS Rule, farms can be either a) not covered b) eligible for a qualified exemption and modified requirements or c) a covered farm.

This document will focus on farms that are “not covered” and farms that are eligible for a qualified exemption and modified requirements. Most small and medium scale farms are likely to fall into these categories.
